What percentage of General Contractors have experienced a construction claim or dispute in the last 5 years?

Service Solution Spotlight | Neutral CCA® For In-House Counsel

If you are in the 83% of General Contractors who have experienced a claim or dispute in the last five years, you’re familiar with the pain that comes with litigation.  To alleviate stress associated with litigation, Proactive has pioneered the Neutral CCA®  process.  Proactive gets to the bottom of project delays, by acting as a neutral investigative party -- finding the root causes of delay, disruption and cost overruns. This process fixes the traditionally-broken process of claim resolution -- where the involvement of multiple advocates makes balanced, accurate assessments of project claims difficult and contentious.

Neutral Collaborative Claims Analysis for In-House Counsel is the powerful alternative to traditional claims management.

This is an extremely powerful tool.  This could be used on a regular basis for subs who aren't performing.

Proactive was recently tasked with providing multifaceted assistance on an apartment complex project, where the wood framing subcontractor defaulted.

The project consisted of two, four-story apartment buildings, both with wood frame structures. After the default occurred, Proactive was hired to help facilitate the recovery process.

To do so, Proactive provided second-set-of-eyes (SSOE) schedule reviews and 2D look ahead graphics.  Through the SSOE schedule review process, Proactive determined that the schedules did not include activities, or the necessary logic, to capture any  deficiency or corrective work being performed on site.

The contractor’s Corporate Scheduler used the 2D look ahead graphics as a communication tool to encourage the project team to follow through with recommendations provided by Proactive.  Proactive also provided Neutral Delay Analysis services.

Proactive’s services were so well received by the project team, the Senior Project Manager stated, “I’m very impressed with the process. You guys are very thorough.”
